Joining the Magic & Mayhem Event as a vendor you hereby agree to:
Effect of this Document:
- The provisions of this agreement are highlighted for the attention of the Indemnifying Party, especially where the Consumer Protection Act 68 of 2008 is applicable to the relationship between Magic & Mayhem (the indemnified party) and the Indemnifying party.
- The effect of this agreement is that the Indemnifying party may have limited or no recourse against the Indemnified Party in the circumstances referred to herein.
Waiver and Indemnity:
- I state that I am participating in the activity offered by the indemnified Party (Magic & Mayhem) of my own free will.
- I confirm that I am over the age of 18.
- I indemnify the indemnified party, its members, directors, and employees against all claims, losses, demands, actions, damages, and causes of action arising directly or indirectly from my acts connected with or arising out of the Activity.
- I understand the inherent dangers of the Activity and acknowledge that the Indemnified Party, its officers, employees, and agents are not responsible for any injuries, property damage, or liability that may arise from my participation.
- I release, agree to indemnify, and hold the Indemnified Party, its officers, employees, and agents free from any and all costs, losses, expenses, damages, claims, suits, causes of action, or any other liability or responsibility resulting from any injury or damage arising from the Activity.
Acceptance:
- By agreeing to be a vendor and settling any fees, I confirm that I have read and understood the contents in effect and agree to be bound by it from the date of payment.
- If any clause in this agreement is unclear, I must request clarification before accepting and concluding this agreement.
General:
- I agree that this agreement may serve as a defense against any action or proceeding brought against the Indemnified Party, its officers, employees, and agents for injuries or damages sustained as a result of the Activity.
- I have read and understand all the terms of this agreement and have voluntarily executed it with full knowledge of its significance.
- I confirm that I fully appreciate the risks associated with my participation in the Activity and voluntarily accept such risks.
- I consent to the lawful collection, processing, storing, and transferring of my personal information by the Indemnified Party and its officers, employees, agents, and third-party service providers in accordance with relevant laws.
- The parties agree that this agreement may be signed electronically in accordance with the Electronic Communications and Transactions Act 25 of 2002.
